General Durable Power of Attorney

A general Durable Power of Attorney is a very powerful document. It allows the maker to give another person the power to do anything and everything on the maker’s behalf that the maker could do himself. It includes, but is not limited to, the power to do banking; pay bills; buy, sell and maintain personal and real property; pay taxes; enter into contracts; and even file lawsuits.
The potential for abuse cannot be over-stated and proper advice on where and when to use such a document is paramount.

Powers of attorney can be tailored to fit a client’s personal needs. Where a person desires to grant power to perform specific tasks, we recommend a Limited POA. POA’s can also be drafted to cover a designated time frame. Springing POA’s are not effective when executed, but spring into existence upon some designated event (such as the maker’s incapacity).    

The durability provision of a general or limited POA must be considered. In Ohio law, a power of attorney ceases to be valid upon the maker’s incapacity. A durability provision ensures that the POA remains valid after incapacity, and may be a necessary provision depending upon your needs.
