Last Will & Testament

Your LW&T not only provides for the distribution of your estate after your death, but allows you to appoint a person to be responsible for carrying out your wishes (the executor), select a guardian for minor children, and control your assets long after your death by means of a testamentary trust.

 

Probate

Probate is the process of paying your debts and distributing the balance of your estate after your death.  If you do not have a LW&T, your assets will be disbursed according to the Statutes of Descent and Distribution.  Many estates qualify for an abbreviated form of Probate called a Release from Administration.  

 

Living Will

Your Living Will is your declaration that you do not want any extraordinary efforts taken to prolong your life if you are in a permanently unconscious state or terminal condition.  

 

Durable Power of Attorney for Health Care

A DPOAHC allows you to appoint someone to make health care decisions for you in the event that you are incapacitated and unable to make health care decisions for yourself.  

 

General Durable Power of Attorney

A general DPOA allows you to appoint someone to handle your affairs.  It grants broad authority to do anything you could do for yourself, including banking, filing tax returns and buying and selling real estate.  A General POA  speaks only during life and the power terminates when the person granting the power dies.  

 

Probate Avoidance

We can assist in the preparation of probate avoidance instruments like Living Trusts, Survivorship deeds, Transfer on Death Deeds and the like.
